These individuals may also be referred to as "Financial Influencers" or "Finfluencers." This overview includes critical information regarding payments, fees, taxes, and limitations, all of which are crucial for creators to understand fully.Creator PageTo assume the role of a creator, one must initiate and launch a dedicated page to offer memberships or services. Upon joining TheFinAdvisor, you integrate into the broader TheFinAdvisor community. The platform provides various tools for creators, enabling them to display their work, interact with community members, and distribute merchandise via our merchandising service. The membership model is designed for creators to connect with their most ardent supporters, providing them with unique benefits such as exclusive access, merchandise, original content, and interactive community experiences. As a creator, you garner sustained support and financial backing from your community members through memberships and offerings acquired on TheFinAdvisor.PaymentsAs a creator on TheFinAdvisor, you have the option to provide offerings on a one-time basis or establish memberships under an automatically renewing subscription model. In jurisdictions where this feature is available and applicable, we may, at our sole discretion, convert the pricing of your offerings and subscriptions to the local currency of community members, utilizing a currency conversion rate determined by us. Additionally, where permissible and under your control, prices of offerings to community members may be adjusted to reflect any fees levied by external platforms (such as the App Store) where purchases are executed, again at our discretion. TheFinAdvisor typically oversees issues related to payment such as fraud detection, chargeback handling, and the resolution of payment disputes. However, transactions conducted through specific platforms (e.g., the App Store) may be subject to the payment issue handling protocols of those platforms. TheFinAdvisor endeavors to facilitate timely access to earned funds, contingent upon the service level and type of TheFinAdvisor service utilized by the creator. Note that the availability of funds may vary based on the originating platform of purchase and the selected TheFinAdvisor service tier, and in certain cases, a reserve may be maintained to prevent immediate access to funds. Delays in fund accessibility may occasionally occur.Furthermore, TheFinAdvisor reserves the right to block or withhold access to funds due to violations of our terms, policies, or for compliance reasons, including the necessity of collecting tax-related information. In such instances, we aim to promptly communicate the cause of the blockage or withholding. Should you have inquiries regarding the restriction or delay in accessing funds, we encourage direct communication with our support team.For the purpose of protecting creators and maintaining platform integrity, TheFinAdvisor may withhold or block payments from community members suspected of fraudulent activity. Refunds issued to community members or chargebacks initiated by them may result in a negative balance in your account, and any fees incurred from TheFinAdvisor or external platforms involved in the transaction may not be reimbursable. In the event of a negative balance, we retain the right to offset this against future payments owed to you.To ensure a safe and inclusive environment, TheFinAdvisor prohibits all creators from disseminating sexually explicit content or material containing nudity. We reserve the right to restrict or revoke access to the platform for any creator who violates these community standards.FeesAs a creator engaging with TheFinAdvisor platform, you are subject to a series of fees associated with your offerings and paid memberships. Detailed descriptions of these fees are continuously updated and available in our Help Centre. It is important to note that these fees are subject to change and may be adjusted with prior notification to you. The exact fees applicable may vary depending on the selected level and type of TheFinAdvisor service, which may include paid membership services, complimentary membership services, and services designed to facilitate one-time transactions. The specific fees include:Platform Fee: This may be a fixed amount or calculated as a percentage of payments processed successfully. It covers general platform maintenance and service.Feature-specific Fees: These fees are associated with particular features of TheFinAdvisor and may be either a flat fee or a percentage of successfully processed payments.Payment Processing Fee: This fee, encompassing both a percentage of successfully processed payments and a fixed amount per transaction, covers the costs related to processing payments from Community members. This includes activities such as recurring billing, handling of declined payments, and anti-fraud measures.Payout Fee: This is the charge for transferring the earnings from TheFinAdvisor to your designated payout method. The amount may differ based on the payout method you select.Currency Conversion Fee: Applicable when payments are processed in a currency different from your payout currency, this fee is calculated as a percentage of the successfully processed payments. Creators can review the fees for offerings and subscriptions within the creator dashboard, though it should be noted that payout fees are not typically listed here. Furthermore, for purchases made through certain platforms (e.g., the App Store), those platforms may impose additional fees. TheFinAdvisor strives to inform you of these additional charges through your creator dashboard and may, where supported and with your consent, adjust the pricing of offerings to Community members to offset these external fees.In instances where a Community member makes a payment in a currency different from that of their payment instrument, or the payment is processed in a different country from the payment instrument, the associated financial institution may impose a foreign transaction fee. Please be advised that TheFinAdvisor does not apply these fees, has no control over them, lacks insight into their application, and does not receive any part of these fees. However, our payment processing decisions may indirectly influence the incidence of such fees.TaxIn order to satisfy our tax obligations, we collect tax identification information and, in certain circumstances, report this information and earnings to tax authorities as legally required. For example, if you are located in the United States or are a United States citizen who has earned $600 or more, TheFinAdvisor is required to issue you a Form 1099-K at year end. For purposes of Forms 1099-K, we treat all creator earnings as earned for the sales of goods or services. You are responsible for reporting any income, withholding or other earnings-based taxes which may be due as a result of money you’ve earned on TheFinAdvisor. You can learn more in our Tax Help Centre. We are additionally responsible for a number of transactional taxes across the world. These include, but are not limited to, Valued Added Tax (“VAT”), Goods and Services Tax (“GST”) and other local service or sales taxes in non-US locations (collectively referred to as “VAT”), as well as state sales tax in the United States. In locales where we are required to collect transaction tax from Community members, invoices presented to and payments processed from Community members will include the tier or customised payment amount plus the applicable tax. Applicable tax will be charged in addition to the price of a relevant transaction based upon the benefits that you indicate that you will be offering. We will use the benefit categories that you assign to your membership or offering to calculate, collect and remit the applicable taxes. You are responsible for ensuring that all of your benefits are properly categorised using good faith efforts and to the best of your ability using the available tools. You agree to provide accurate information when you are engaging with the tier tools, sales tax weighting tools and, generally, when listing and categorising benefits transferred within membership tiers and offerings. Once settled, the tax amount will be automatically deducted and we will remit directly to the applicable taxing authority. A record of the transaction tax portion of the payment will be available on your earnings details page.Amounts payable under this agreement between a creator and TheFinAdvisor may include VAT or sales tax where applicable. Please refer to our Tax Help Centre in this regard. You agree that you will provide us with any information and documents for accurate tax determination and compliance, where and as we request or as otherwise required.RestrictionsTheFinAdvisor enforces strict compliance with our terms and policies, which are detailed in our Community Guidelines and Benefit Guidelines. The core prohibitions under these guidelines include:Creations or benefits that are unlawful;Creations or benefits that display hostility or abuse towards individuals;Creations or benefits that are fraudulent, misleading, or deceptive;Creations or benefits that infringe upon others' intellectual property rights, barring instances where you possess explicit written authorization or your usage qualifies as fair use; andCreations or benefits depicting real individuals in sexual activities.Creators must ensure that their content is appropriate for all community members, including minors. If your content is accessible to individuals under 18 years of age, you must remind them to obtain consent from a parent or legal guardian to purchase offerings or memberships on TheFinAdvisor. Please note, individuals under the age of 13 are prohibited from using TheFinAdvisor. We reserve the right to deny service to any individual or group without obligation.Furthermore, as a creator, you bear the responsibility for the protection of community members' data in accordance with our Data Processing Agreement, also known as the Creator Privacy Promise.Please be aware that an account on TheFinAdvisor is intrinsically linked to the original creator's intellectual and creative output and may not be sold, transferred, or used by another individual.TheFinAdvisor is committed to continual improvement and innovation. Consequently, we may test, modify, or eliminate product features, providing access to a select group of creators. These modifications are not guaranteed to be within your control and may be implemented or withdrawn at our discretion. Community Member This section provides an overview of the rights and responsibilities of Community Members on TheFinAdvisor. Community Members are individuals who subscribe to, or make purchases on, TheFinAdvisor, potentially receiving special benefits from creators they support. Through these transactions, Community Members gain access to exclusive content and can engage directly with creators and other Community Members via tools provided by TheFinAdvisor.Community Member Support and BenefitsBy supporting a creator, you may become eligible for special benefits such as acknowledgements, unique creations, or merchandise, based on the terms of your subscription or purchase. Payments are processed either on a one-time basis or through automatically renewing subscriptions, with TheFinAdvisor serving as the billing entity. In the event of primary payment method failure, backup payment methods may be charged according to your settings.The specifics of each subscription or offering—including timing, amount, and the nature of benefits—depend on the agreement with the creator you are supporting. Details of these arrangements are available prior to purchase, and your active subscriptions and billing history are accessible for review.License and Subscription TypesUpon full payment and adherence to these terms, Community Members receive a non-exclusive, non-transferable, revocable, limited license to access and view content provided by creators, solely for private, non-commercial use. This content may become unavailable under certain conditions.TheFinAdvisor offers three main types of paid, automatically renewing subscriptions: monthly, per-creation (with a limit option), and annual (often at a discount). Subscription availability varies by creator. All paid subscriptions auto-renew according to their cycle until cancelled through membership settings. Increases in subscription costs, reflecting changes in creator offerings or currency exchange rates, will be communicated in advance.Cancellation and Tier AdjustmentsMemberships can be cancelled or adjusted through your membership settings, impacting the next billing cycle. Reducing support or cancelling may result in loss of access to certain content or benefits. Access may also be lost due to factors like payment failure, account termination, creator actions, or changes by TheFinAdvisor.Content Quality and ScreeningWhile TheFinAdvisor attempts to verify creator identities and offerings, we cannot guarantee all content or claims. We rely on Community Members to report fraudulent or suspicious activity to maintain platform safety.Tax and Payment ProcessingApplicable taxes, such as VAT or sales tax, are added to transactions based on jurisdictional requirements and displayed at the time of purchase. TheFinAdvisor is not responsible for foreign transaction fees imposed by your bank, which may vary based on payment currency or the location of payment processing.Product Testing and Refund PolicyTheFinAdvisor continually tests product features, which may be available to a subset of Community Members. These features are not guaranteed and may be subject to change. Generally, refunds are not provided except in specific cases at our discretion. Refund requests for purchases made through third-party platforms must be directed to those platforms.By engaging with TheFinAdvisor, you agree to these terms, acknowledging that your participation supports creators while granting you access to unique content and experiences.All about being a Community memberA community member is someone who subscribes and/or makes a purchase on TheFinAdvisor, which may come with special benefits from creators they love. Through a subscription or offering on TheFinAdvisor, community members may receive benefits and directly interact with creators using tools supplied by us and, through TheFinAdvisor, have the opportunity to engage with a community of community members and creators.Support and Benefits:As a Community Member on TheFinAdvisor, your financial contributions support individual creators, enabling you to potentially receive exclusive benefits such as acknowledgments, unique content, or merchandise. Payments are structured either as one-off transactions or via auto-renewing subscription models, with TheFinAdvisor acting as the billing agent. In instances where the primary payment method is declined, alternate payment arrangements you have provided may be utilized according to the configurations you have established.Subscription Details and Licensing:The specific details, including the timing and amount of your subscription or offering, are contingent upon the subscription model and the creator you elect to support. Prior to finalizing a transaction, you will be furnished with all pertinent details regarding your purchase. As a subscriber or purchaser on TheFinAdvisor, you are granted a non-exclusive, non-transferable, revocable, limited license to access and utilize the creator’s content, strictly for private, non-commercial purposes.TheFinAdvisor facilitates three primary types of auto-renewing paid subscriptions: monthly, per-creation (with a cap feature), and annual (usually offered at a discount). Availability of subscription types varies by creator. Further information is available in our Help Centre.TheFinAdvisor's roleMonitoring and Enforcement of Terms and Policies on TheFinAdvisorTheFinAdvisor conducts regular reviews of user pages and posts to ensure compliance with our terms, and policies, including the Community Guidelines and Benefit Guidelines. We also investigate reports alleging potential violations. Please be aware that these investigations may extend beyond the confines of TheFinAdvisor, particularly as actions taken with earnings on the platform may pose risks to TheFinAdvisor. Investigations are thorough and may require considerable time to complete.In instances of potential policy breaches, our general approach involves collaborating with the involved parties — creators or community members — to address the issues, aiming for resolution and continued participation on TheFinAdvisor. However, account termination for creators or community members may occur if deemed necessary to safeguard the interests and security of other users, the platform, or the wider community. Such decisions are made with careful consideration and as a last resort.Furthermore, TheFinAdvisor maintains the authority to disqualify users from participating in annual memberships. Should a creator be disqualified, they will no longer be able to offer annual subscriptions to new community members. Similarly, a community member’s disqualification prevents them from subscribing to any new annual memberships. This action does not automatically result in removal from TheFinAdvisor unless additional, separate grounds for such removal exist.We encourage the reporting of any activities believed to be in violation of our Community Guidelines. Instructions for submitting such reports can be found on our platform.As an entity based in the United States and operating internationally, TheFinAdvisor is obliged to adhere to economic sanctions and trade restrictions, including those enforced by the United States Department of the Treasury’s Office of Foreign Assets Control (OFAC). Consequently, TheFinAdvisor is prohibited from engaging in transactions with certain designated individuals, regions, or items emanating from those regions as determined by regulatory bodies like OFAC. Detailed information on these restrictions is available in our Sanctions Policy.Account deletionYou may elect to permanently terminate your account by navigating to our Privacy Centre at your convenience.TheFinAdvisor reserves the right to terminate or suspend your account, cancel any membership subscriptions, and remove any content including descriptions, posts, offerings, or benefits, according to our sole discretion, without prior notice. Under no circumstances shall you initiate legal action against TheFinAdvisor for the suspension or termination of another user's account, and by agreeing to these terms, you expressly waive the right to file such claims. Should you contravene this agreement by initiating such a claim, you shall be liable for all resulting damages incurred by TheFinAdvisor, including but not limited to attorney’s fees and court costs.Furthermore, it is important to understand that certain provisions of these terms, including but not limited to indemnification obligations and liability limitations, will remain binding and in full effect even subsequent to the deactivation or deletion of your account.Your creationsCreators retain full ownership of their intellectual properties and Community Members retain full ownership of their postings on TheFinAdvisor. However, in order to facilitate the effective operation of TheFinAdvisor's services, we require from you a royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, worldwide license to utilize, modify, reproduce, store, translate, transmit, distribute, execute, create derivative works, and publicly exhibit your creations or postings. This license extends to all formats and channels, whether currently known or later developed, across the globe, and may include the use of any name, username, voice, or likeness associated with the content. In instances where your creations include personal data, you acknowledge TheFinAdvisor's "legitimate interest" in such data within the confines of this license.The scope of this license is necessary for the provision of TheFinAdvisor's services, which include hosting of content, promotion of memberships to your Community Members, and facilitation of community features like comments on posts. Our use of your creations is strictly limited to enabling and promoting memberships and offerings you configure on TheFinAdvisor, without the intention to exploit or derive profit from your creations beyond the facilitation of these services.You covenant not to post or make available on TheFinAdvisor any content that infringes upon the intellectual property or proprietary rights of others. TheFinAdvisor reserves the right to remove content and materials infringing on its terms and policies, including these Terms of Use and Community Guidelines. We adhere to and enforce a policy addressing the compliant notifications of claimed copyright infringement, which includes the termination of accounts of creators and Community Members identified as repeat infringers under certain conditions. You may also revoke this access.Upon linking your TheFinAdvisor account with external websites, applications, or services, you may be prompted to authorize these entities to access specific information pertaining to your TheFinAdvisor account and/or to allow them to undertake certain actions on your behalf within your TheFinAdvisor account. Should you decide to grant such authorizations, TheFinAdvisor shall comply with your directives and extend the access or permissions as dictated by your selections. Any use, reproduction, distribution, performance, public display, or creation of derivative works based on TheFinAdvisor's intellectual properties, other than as expressly permitted herein, requires prior written consent from TheFinAdvisor.
